SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, and you consent to allow any minor dependents to use the Services on devices you own or manage.

You are responsible for maintaining the security of your account credentials and all account activity. You may not transfer, sell, or assign your account to any other person.

We make every effort to display our products accurately; however, colors and appearance may vary depending on your device and settings. We do not warrant that product appearance or quality will meet your expectations.

Product descriptions may change without notice. We may discontinue products or limit quantities at our discretion.

SECTION 3 – ORDERS

When you place an order, you make an offer to purchase. Pump Bear may accept or decline your order for any reason. Your order is not accepted until we confirm acceptance and process payment.

Please double-check your order before submitting. We may not be able to cancel or modify an order after it is accepted.

Orders may only be returned or exchanged in accordance with our Refund Policy /policies/refund-policy. You represent that your purchases are for personal use and not for commercial resale.

SECTION 4 – PRICES AND BILLING

Prices, promotions, and discounts may change without notice. The price charged is the price in effect at the time you place your order.

Unless otherwise stated, prices do not include taxes, shipping, customs, or import charges.

You agree to provide complete and accurate payment information and to update your account details as needed.

You represent and warrant that:
(i) your payment information is valid;
(ii) you are authorized to use the payment method;
(iii) all charges will be honored;
(iv) you will pay all incurred charges, including taxes and shipping.

SECTION 5 – SHIPPING AND DELIVERY

Delivery times are estimates only. We are not liable for delays caused by carriers, customs, or events outside our control.

Once we transfer products to the carrier, risk of loss passes to you.

SECTION 6 – INTELLECTUAL PROPERTY

All content on the Services—including text, images, graphics, trademarks, audio, video, and design—is owned by Pump Bear or its licensors and protected by intellectual property laws.

You may only use the Services for personal, non-commercial purposes.

You may not reproduce, modify, copy, distribute, or exploit any portion of the Services without our written permission.

Pump Bear’s name, logo, and branding are trademarks of Pump Bear. Shopify’s marks belong to Shopify.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools which we do not control. These tools are provided “as is” and “as available.” You use them entirely at your own risk and must review the third party’s terms.

Future new features will also be subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain links to third-party websites. We are not responsible for their content or accuracy and are not liable for damages related to your use of third-party sites.

Please review their policies before engaging in any transaction with them.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Pump Bear is powered by Shopify. Any sales made through our Store are made directly with Pump Bear, not Shopify.

By using the Services, you agree that Shopify is not responsible for your transactions, purchases, or any related damages. You expressly release Shopify from all claims arising from your interactions with Pump Bear.

SECTION 10 – PRIVACY POLICY

Personal information collected through the Services is subject to our Privacy Policy /policies/refund-policy and Shopify’s Privacy Policy.

Because Shopify hosts the Services, Shopify collects and processes personal information to operate and improve the Services.

Your information may be transmitted to Shopify and third-party partners in other countries as needed to provide our Services.

SECTION 11 – FEEDBACK

If you submit any Feedback (ideas, reviews, suggestions, etc.), you grant Pump Bear a perpetual, worldwide, royalty-free license to use, publish, modify, and distribute it for any purpose.

You represent that you own your Feedback and it does not violate any rights.

We may remove or edit Feedback that violates these Terms.

SECTION 12 – ERRORS AND INACCURACIES

Occasionally, the Services may contain errors, inaccuracies, or omissions related to product descriptions, pricing, availability, or shipping information.

We reserve the right to correct errors or cancel orders affected by inaccuracies.

SECTION 13 – PROHIBITED USES

You agree not to use the Services for unlawful or harmful purposes, including but not limited to:

  • violating laws or third-party rights

  • transmitting misleading information

  • sending spam or malicious code

  • impersonating others

  • scraping, crawling, or data mining

Sections concerning Intellectual Property, Feedback, Disclaimer, Limitation of Liability, Indemnification, Severability, Governing Law, and others will survive termination.

The Services and all products are provided “as is” and “as available,” without warranties of any kind unless expressly stated by Pump Bear.

We do not guarantee uninterrupted or error-free operation.

To the fullest extent permitted by law, Pump Bear and its partners, employees, contractors, affiliates, and Shopify will not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of the Services or products.

You agree to indemnify and hold harmless Pump Bear, Shopify, and their affiliates from any claims arising from your use of the Services, your violation of laws, or your breach of these Terms.

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions remain in effect.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Failure to enforce any right does not constitute a waiver.
These Terms constitute the entire agreement between you and Pump Bear.

SECTION 20 – ASSIGNMENT

You may not assign these Terms without our written consent. We may assign them without notice.

SECTION 21 – GOVERNING LAW

These Terms are governed by the laws of the jurisdiction where Pump Bear is headquartered, and you consent to the jurisdiction of those courts.
